1. Acceptance of Terms 

By accessing or using Clinic Scale's website, services, or submitting an application, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, do not use our services. 

2. Services Provided 

Clinic Scale provides digital marketing and lead generation services specifically for Scalp Micropigmentation (SMP) clinics, including but not limited to: 

Facebook and Instagram advertising campaign management 

AI-powered lead follow-up and qualification 

Automated appointment booking systems 

Marketing strategy consultation 

Performance reporting and analytics 

3. Eligibility 

To use our services, you must: 

Be at least 18 years of age 

Have the legal authority to enter into binding contracts 

Operate a legitimate SMP clinic or business 

Comply with all applicable laws and regulations in your jurisdiction 

4. Application and Acceptance 

Submitting an application does not guarantee acceptance as a client. Clinic Scale reserves the right to accept or decline any application at our sole discretion based on: 

Availability in your region 

Suitability of your business for our services 

Compliance with our eligibility requirements 

5. Service Agreement and Payment Terms 

5.1 Service Fees 

Monthly management fees are outlined in your individual Service Agreement 

Fees are billed in advance and are due on the agreed-upon date 

Payment methods accepted include credit card, debit card, or bank transfer 

5.2 Advertising Spend 

You are responsible for all advertising spend paid directly to third-party platforms (Meta/Facebook, Google, etc.) 

Advertising budgets are separate from our management fees 

We do not control or guarantee ad platform pricing 

5.3 Refund Policy 

Management fees are non-refundable once services have commenced 

If you cancel within the first 7 days and no campaigns have launched, a prorated refund may be issued at our discretion 

Advertising spend paid to third-party platforms is non-refundable under any circumstances 

5.4 Late Payment 

Late payments may result in suspension of services 

A late fee of $50 or 5% of the outstanding balance (whichever is greater) may be applied after 7 days 

Continued non-payment may result in termination of services and collection action 

6. Client Responsibilities 

You agree to: 

Provide accurate and complete information about your business 

Respond promptly to requests for content, access, or information 

Grant necessary access to advertising accounts, calendars, and systems 

Maintain compliance with all platform policies (Facebook, Instagram, Google) 

Provide high-quality images, content, and materials when requested 

Inform us immediately of any changes to your business or contact information 

7. Advertising Platform Compliance 

You acknowledge and agree that: 

All advertising campaigns must comply with Meta (Facebook/Instagram) and Google advertising policies 

Your business, services, and content must meet platform guidelines 

Clinic Scale is not responsible for ad disapprovals, account suspensions, or policy violations caused by your business practices or content 

Ad platforms may reject or remove campaigns at their discretion 

8. Results and Performance Disclaimer 

NO GUARANTEE OF RESULTS 

Clinic Scale makes no guarantees, representations, or warranties regarding: 

Specific numbers of leads, enquiries, or bookings 

Revenue increases or return on investment (ROI) 

Advertising performance or cost-per-result metrics 

Marketing results depend on numerous factors including but not limited to: 

Market conditions and competition in your area 

Quality of your services and pricing 

Seasonality and economic conditions 

Your responsiveness to leads and consultation conversion rate 

Advertising platform algorithm changes 

Quality of materials and content you provide 

Past performance of other clients does not guarantee or predict your results. Testimonials and case studies represent individual results and may not be typical. 

9. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW: 

Clinic Scale's total liability for any claims arising from or related to our services shall not exceed the total amount you paid us in the three (3) months immediately preceding the claim. 

Clinic Scale is not liable for: 

Lost profits, revenue, or business opportunities 

Indirect, incidental, consequential, or punitive damages 

Issues caused by third-party platforms (Facebook, Instagram, Google, etc.) 

Results affected by factors outside our reasonable control 

Actions or inactions of your business in responding to leads 

Changes to advertising platform algorithms, policies, or pricing 

Technical failures, service interruptions, or data loss
